PRIVACY POLICY

OF KANCELARIA PRAWNA – JOLANTA KAMIŃSKA

(hereinafter referred to as the Law Firm)

 

§ 1

The purpose

The purpose of the Privacy Policy in the Law Firm is to explain the principles of personal data processing and to present the basic rights related to their processing by the Law Firm.

The processing of personal data by the Law Firm is carried out in in accordance with the applicable provisions on protection of personal data, in particular in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as GDPR) and with the Act of 10 May 2018 on personal data protection.

Personal data of persons contacting the Law Firm are processed exclusively in order to respond to requests or inquires related to cooperation with the Law Firm and in order to present an offer of cooperation with the Law Firm upon request or in relation to cooperation undertaken in regards to ongoing legal services provided to the Clients of the Law Firm, including the purpose of ongoing contacts regarding the matters connected to the performance of orders which were entrusted to the Law Firm and in connection with which the Law Firm was provided with the personal data. 

The legal grounds for processing data is the legitimate interest of the Law Firm (Art. 6 subsec. 1 letter f GDPR) in the form of responding to inquiries, establishing relation with the person contacting the Law Firm and presenting an offer of cooperation with the Law Firm as well as cooperation with the Law Firm upon request.

The Law Firm processes personal data in particular for the purpose of:

- providing legal services,

- cooperation with other entities regarding the matters of the Clients of the Law Firm,

- cooperation with suppliers of goods and services,

- ensuring protection of information and communications technology (ICT) related to the website of the Law Firm,

- fulfilment of the duties of the Law Firm arising from the law.

The consent to the processing of the given personal data may be withdrawn at any time. The withdrawal of the consent will not affect the lawfulness of the processing which was performed before the consent was withdrawn.

 

§ 2

§ 3

The scope of personal data processing

The Law Firm processes personal data in the following scope: name and surname, address, telephone number, PESEL number, e-mail address.

The Law Firm does not process personal data in an automated manner, including data profiling.

 

§ 4

Rights of persons whose personal data are processed by the Law Firm

1. The processing of personal data by the Law Firm is based on consent.

2. The consent to the processing of personal data may be withdrawn at any time. The withdrawal of consent will not affect the lawfulness of processing which was performed based on the consent before it was withdrawn.

3. Persons whose personal data are processed by the Law Firm have the following rights:

  • the right to information,
  • the right to access to data,
  • the right to rectify data,
  • the right to erasure of data,
  • the right to restrict processing of data,
  • right to object to the processing of data.

Persons whose data are processed by the Law Firm have the right to lodge a complaint against the processing of personal data with the President of the Personal Data Protection Office [Prezes Urzędu Ochrony Danych Osobowych] if they believe that the processing of their personal data violates the applicable provisions on processing of personal data.

 

§ 5

Restriction on data transfer

The Law Firm does not transfer, does not sell and does not lend the collected personal data to other persons or institutions, unless it does so with the express consent or upon request or it results directly from the fact of entrusting the case to the Law Firm or at the request of authorised state bodies for the purpose of the proceedings conducted by those bodies.

The Law Firm does not transfer personal data to the countries outside the European Economic Area or to international organisations, unless it is required in relation with the case entrusted to the Law Firm by the Client. 

 

§ 6

Data retention period

The Law Firm stores personal data, depending on the grounds and purpose of processing, for the time which is justified by execution of the order, until the expiry of all of the limitation periods related to the contract in connection with which the personal data are processed and until the expiry of all of the limitation periods of duties arising from the law, in particular the Polish civil code and relevant Acts of Polish law, as well as the European Union law, in particular the GDPR (the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC).

 

§ 7

Cookies Policy

The website https://kpjk.waw.pl (hereinafter referred to as the Website) uses cookies. Using the Website is equivalent with the consent of the Website User to the use of cookies in accordance with the following Cookie Policy. If the User does not consent to the use and to the processing of cookies, they may either change the Internet browser settings or stop using the Website.

Cookies are information which are saved on the computer of the User (tablet, smartphone) and which are read by the Website each time during a connection. Usually, a cookie consists of the name of the website it comes from, an indication of the storage period and number.

The Website uses cookies to facilitate the use of the Website and to accelerate the use of the Website.

Cookies can be used to create statistics on how the Users use the Website.

It is possible to block the automatic support of cookies or to enable warnings to inform each time that a cookie is sent to the device. Information on the proper functions of the software is available in the Internet browser settings and on the websites of the software producers.  

If the Website User does not make any changes to the Internet browser settings, cookies will be saved on the terminal device and used by the Website in accordance with this Cookies Policy.

 

§ 8

Changes to the Privacy Policy

1. The Law Firm reserves the right to change this Privacy Policy at any time.

2. By using the Website of the Law Firm, the User accepts this Privacy Policy. If they do not accept this Privacy Policy, they should stop using the Website of the Law Firm.

3. Changes to the Privacy Policy enter into force upon their publication on the Website https://kpjk.waw.pl.
